01 What these terms cover
These terms apply to the Swarm website, the demo screens, the sign-in gate and the hosted application. They are an agreement between you and the Operator whose details are at the end of this page. If you do not accept them, do not use the site.
What the service costs and how it is bought is in the public offer. What happens to personal data is in the privacy policy. What may be sent through the product is in the acceptable use policy.
02 Access and credentials
Swarm instances are single-tenant. Accounts are created on the server side by the Operator or by the Customer's own administrator; there is no public self-registration, and no account is created by the act of visiting the site.
Sign-in is by operator name and password at /signin.html. Sign-in with a Google account is implemented in the product but is switched off at the moment; when it is switched on, only addresses that the instance owner has put on the allow-list will be admitted, and the only data taken from Google is the email address and the confirmation that Google authenticated it.
You are responsible for everything done under your credentials. Sign-in attempts are rate-limited and logged. Tell the Operator at once if you believe credentials have been exposed.
03 What you may not do
- probe, scan or load-test the service, or try to get around the gate, the rate limits or the role checks;
- copy the site's code, design or texts for a competing product, or use automated collection against it;
- reverse-engineer the product except to the extent the law says cannot be prohibited;
- upload malware, or use the product to phish, impersonate or defraud;
- use another operator's account, or share your own with people outside the Customer's team.
04 Rights in the product and in your data
The Swarm name, logo, interface, texts and code belong to the Operator. Using the service does not transfer any of that; you get a non-exclusive, non-transferable right to use it while the contract is in force.
Your data stays yours. Lead lists, conversations, campaign settings and reports on your instance belong to the Customer, can be exported at any time, and are handled under the data processing addendum.
If you send the Operator an idea or a bug report, the Operator may use it to improve the product without owing you a fee for it.
05 Demo screens
The screens linked as “live demo” from the marketing pages are static mock-ups filled with synthetic data. No real lead is shown there, nothing is sent from them, and no number, name or company on those screens belongs to a real person.
06 The support assistant
The support widget on the site answers from the product documentation using a third-party language model. Your question and the text you paste into it are transmitted to that provider to produce the answer, and are stored in the Operator's logs for support quality.
Do not paste passwords, API keys, client lists or anything else confidential into it. An answer from the assistant is help, not a contractual commitment: where it differs from these documents, these documents win.
07 Availability
The Operator aims to keep the service continuously available and to run planned maintenance outside business hours, announcing it in advance where it will be noticeable. Outside plans that include a written SLA, availability is provided on a best-effort basis and no uptime figure is guaranteed.
08 Disclaimers
The site and the demo material are provided as they are. The Operator does not warrant that outreach through Swarm will produce a particular reply rate, that a messaging platform will keep an account open, or that content generated by the model will be free of error — which is why the product routes anything that looks like a commitment to a human operator.
Liability limits are those set out in the public offer.
09 Changes and contacts
These terms may be updated; the current version is the one published here, with its revision number and date at the top. Material changes take effect 10 calendar days after publication.
